Please read these Terms and Conditions ("Terms") carefully before using the Mamma Mia Meals website (the "Site") or placing an order. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site or place an order.

1. About Mamma Mia Meals

Mamma Mia Meals is a DBA of MS Chase LLC. We offer a curated selection of Italian-inspired pasta, sauces, soups, desserts, and other specialty food products for home preparation and enjoyment.

Certain products are prepared and packaged by licensed commercial food establishments and distributed or sold through Mamma Mia Meals. Products are not prepared in a private residence or operated as a cottage food business.

Product availability, ingredients, preparation requirements, and storage instructions may vary by product. Please review the product description and packaging information before ordering.

2. Orders

• All orders are placed and paid for through the Site.

• By placing an order, you represent that all information you provide, including your name, delivery address, contact information, and payment information, is accurate and complete.

• We reserve the right to refuse, limit, or cancel any order at our discretion, including in cases of suspected fraud, pricing or product-description errors, product unavailability, or inability to fulfill delivery within our current service area.

• Product availability, descriptions, ingredients, packaging, and prices are subject to change without notice.

• An order is considered confirmed only after payment has been successfully processed and an order confirmation has been issued.

3. Delivery Area and Scheduling

• We currently offer local delivery only within the following ZIP codes: 33139, 33140, and 33141.

• Deliveries are made within a scheduled delivery window of 10:00 AM to 12:00 PM.

• We do not currently offer shipping through mail carriers or customer pickup.

• Delivery within our designated service area is currently the only fulfillment method available.

4. Payment

• Payment is due in full online through the Site at the time the order is placed.

• We use a third-party payment processor to securely process transactions. We do not store your full payment card information on our own servers.

• All prices are listed in U.S. Dollars.

• Applicable sales tax and delivery fees, if any, will be displayed at checkout.

5. Cancellations and Refunds

• Orders may be cancelled before food preparation or fulfillment has begun.

• If you wish to cancel an order, please contact us at hello@mammamiameals.com as soon as possible.

• Cancellations requested before preparation or fulfillment begins may be eligible for a full refund.

• Once preparation or fulfillment has begun, orders generally cannot be cancelled or refunded because ingredients, products, packaging, and labor may have already been committed.

• If a refund is approved, it will be issued to the original payment method within a reasonable processing period.

• If your order arrives damaged, incorrect, or in a condition that raises a food-safety concern, please contact us promptly so that we can review the situation and determine an appropriate resolution.

6. Food Safety, Allergens, and Storage

• Our products may include fresh, refrigerated, frozen, and other perishable food items.

• Upon delivery, customers are responsible for promptly refrigerating or freezing products as indicated on the product packaging or accompanying instructions.

• Customers are responsible for following all storage, handling, cooking, and reheating instructions provided with each product.

• Our products may contain, or may come into contact with, common allergens, including but not limited to wheat/gluten, eggs, milk/dairy, soy, fish, shellfish, peanuts, and tree nuts.

• If you have a food allergy, intolerance, or dietary restriction, please contact us before placing your order.

• We cannot guarantee that any product is completely free from allergen cross-contact.

• Customers are responsible for properly storing and handling products after delivery.

• We are not responsible for food spoilage, illness, or adverse reactions resulting from improper storage, handling, preparation, or consumption after delivery, or from an allergy or dietary restriction that was not disclosed to us before ordering.

7. Limitation of Liability

To the fullest extent permitted by applicable law, MS Chase LLC, doing business as Mamma Mia Meals, and its owners, employees, contractors, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Site or the purchase, preparation, storage, or consumption of our products, except to the extent such liability cannot legally be excluded or limited.

To the fullest extent permitted by law, our total liability arising out of or relating to any order shall not exceed the amount actually paid for that order.

Nothing in these Terms is intended to exclude or limit any rights or remedies that cannot legally be excluded or limited under applicable law.

8. Intellectual Property

All content on the Site, including text, product descriptions, recipes, graphics, logos, photographs, images, branding, and other materials, is owned by MS Chase LLC or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, publish, display, or commercially use Site content without our prior written consent.

9. Website Use

You agree not to:

• Use the Site for any unlawful purpose;

• Interfere with or disrupt the operation or security of the Site;

• Attempt to gain unauthorized access to the Site, accounts, systems, or networks;

• Submit false, misleading, or fraudulent information; or

• Use the Site in a manner that could damage, disable, overburden, or impair its operation.

10. Changes to These Terms

We may update or modify these Terms from time to time. The "Last Updated" date at the top of this page indicates when the Terms were most recently revised.

Any updated Terms will become effective when posted on the Site. Your continued use of the Site or placement of orders after updated Terms are posted constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms, the Site, or an order shall be subject to the applicable jurisdiction of the state or federal courts located in Miami-Dade County, Florida, unless otherwise required by applicable law.
